In order to petition for your spouse you have to be a resident or a citizen. That's number one. Number two the marriage has to be legitimate or in good faith. You can't be getting married just to give her the papers. You've got to live together as husband and wife, everything normal in your relationship. That's number one. Once we've established those two basic requirements then we can develop a strategy, and it depends if you're a resident or a citizen, how the person entered the United States, and if they're legal in the United States. Why? Because for example, if you're married to a US citizen and you enter legally into the United States, we're going to jump straight into the residency. We're going to ask for a world permanent travel document, and in less than a year we can make you a resident through immigration of course. Now, if your spouse is a resident then we're going to start with the petition, then we're going to do a waiver, and it's a multi-step process. And the planning is the key.
